Available to IBABC members only, this full-day seminar will provide you with proven, practical techniques to help protect your brokerage from loss resulting from E & O claims. If you are an IBABC member in good standing, attending this seminar will save your brokerage money as it will qualify you for a 10% premium credit on your next renewal under the members’ Errors & Omissions Program, which is required every three (3) years.

Who Should Attend: All IBABC member brokers at all levels. For Member Brokers who have already attended this seminar, be sure to send your CSR’s and other brokerage personnel as this seminar will provide them with an invaluable lesson in E & O prevention.

These illegal operations tend to cause significant water, moisture, mould, fire and/or explosion damage to residential and, in some cases, commercial properties. Learn from a remediation expert the extent of the devastation that these operations cause, what you and your clients should be aware of, and how resulting losses are remediated. Included in the discussion will be: grow operations (soil based and hydroponic); meth and cocaine labs; health and safety concerns; environmental concerns; building concerns; municipal regulations; assessment issues; and remediation methods. In this in-depth seminar, you will learn about issues arising out of the ownership, occupation and insurance of strata property. You will review the Strata Property Act of BC and recent court decisions to examine the legal obligations of the owner developer, Strata Corporation, strata lot owner, and strata council members. In addition, you will learn about the specific provisions in the Strata Property Act regarding insurance, overlapping coverage between the corporations and unit owner’s policies, waivers of subrogation, responsibilities for deductibles, and more.

In British Columbia, the Occupiers Liability Act supplants the common law and imposes a positive duty on occupiers to take steps to protect persons and their property when they enter the occupier’s premises. In this seminar, you will learn some of the key issues which arise under this Act. You will review the framework of the Act, including general principles of who is an occupier, what constitutes premises under the Act and what duty of care is owed by an occupier. Along the way, you will review some recent decisions and trends in the case law.

In this half-day seminar, you will get an overview of property coverage and claims under Commercial and Personal Lines policies. You will consider recent Canadian court cases in this area, including the recent Supreme Court of Canada decisions which significantly impact the limitation periods under multi-peril policies. You will review the scope of Builder’s Risk insurance, including an in-depth discussion of who is insured and which risks are insured. Also discussed will be the common exclusions in property policies, case law affecting their interpretation and application, as well as the doctrine of subrogation in a first party context and (time permitting) fraudulent property insurance claims.
