Crime coverages tend to be overlooked by many brokers, partly because the exposures are not as apparent in the same way as physical property and liability risks are. This is a serious problem as Canadian businesses experience significant amounts of crime claims every year, many of which are either uninsured or woefully deficient in carried limits. In this session, you will take a look at all of the common exposures faced by commercial clients, look at loss examples, and evaluate applicable wordings. Contemporary Liability Coverage, Part 1 - The Coverage Dilemma

In 2005, three of Canada’s largest insurers rolled out the “New IBC CGL.” Interestingly, these companies write roughly half of the total premium in the country. One other has followed. The remainder of the marketplace has elected to continue using the broader “Old CGL” form in order to compete. The “New IBC” policy form attempts to overwrite established insurance law by imposing potentially onerous conditions on insureds. If they fail to meet those conditions, coverage is denied. Over the last year, it has become clear that many brokers haven’t fully appreciated that moving their clients from one form to another, even with the same companies, can expose insureds to uncovered losses and their own firms to significant E&O exposures. In this seminar, you will undertake a case study to walk step-by-step through a variety of claims scenarios while learning how the “New IBC CGL” operates very differently from the “Old IBC CGL” form.

Contemporary Liability Coverage, Part 2 – Exclusions and What to do About Them

This seminar continues on from the morning’s ‘Part 1 - Coverage Dilemma’ session. You will explore the operation of various exclusions in a number of claims scenarios. By doing so, in addition to becoming better familiar with the CGL policy wording, you will become more aware of the general legal principles that govern the interpretation of CGL policies and the application of its various exclusions and limitations. Some of the exclusions are unique to some of the “New IBC CGL” forms while others are common to both the “New” and “Old” forms.

Every broker who submits a property risk - and often a liability risk - to an underwriter needs to appreciate the physical aspects that the underwriter will look for.
